General Terms
  • Diwerse is owned and operated by Diwerse (Pvt) Ltd.
  • When you use Diwerse.com ["Diwerse"] and its sub-domains, provided by Diwerse Pvt. Ltd., you agree to the following terms and conditions ["Terms of Use" or "The Agreement"].
  • Diwerse may change these terms at any time. Please check these terms regularly to stay informed of any changes. Continuing to use Diwerse.com after updates means you agree to the updated terms.
  • You must be 18 years of age or older or you will not be able to enter into a legally binding contract to buy or sell via Diwerse.
  • If you register to sell on Diwerse as a registered business or an individual you must guarantee that you personally have the authority of the business to agree to the terms of use.
  • These terms shall be governed by and interpreted in accordance with the law of Sri Lanka.
Behavior
  • You are prohibited from engaging in any illegal or unauthorized activities on Diwerse. You must comply with all local laws governing online behavior and content, including libel laws.
  • Selling counterfeit items or violating the copyright, trademark, or other rights of third parties is strictly prohibited.
  • Threatening, intimidating, harassing, or abusing other Diwerse users is not allowed.
  • You must ensure that the content you submit belongs to you and is not owned by anyone else. You are responsible for your actions and behavior on www.diwerse.com, including all content you post such as images, audio, video clips, links, and text.
  • Modifying, adapting, or attempting to hack www.diwerse.com is prohibited.
  • Creating another website or any form of communication that suggests association with Diwerse.com is not allowed.
User Account
  • Ensure all provided information is accurate, complete, and up-to-date when creating a Diwerse account. Do not disclose your password to third parties. Notify us immediately of any suspected security breach or unauthorized account use.
  • Do not use the name of another active business or collecting user information without explicit consent is not allowed.
  • Maintaining multiple accounts is considered as spam and unfair manipulation.
  • Avoid soliciting for new business or sending unsolicited communications except for essential Diwerse-related matters. Do not link out from Diwerse to your own shop or other selling platforms. Diwerse is primarily for selling and not as a lead generator or marketing platform for external sites or services.
  • Failure to do so violates the Terms, which may lead to immediate termination of your www.diwerse.com account.
  • You must agree to the terms outlined in the Privacy Policy.
Content Restrictions
  • You are prohibited from transmitting any content that is unlawful, offensive, disturbing, intended to disgust, threatening, libelous, defamatory, obscene, or otherwise objectionable. Examples include:
    • Content promoting unlawful activities.
    • Defamatory, discriminatory, or mean-spirited content.
    • Spam, unauthorized advertising, or chain letters.
    • Content containing viruses or harmful elements.

  • While regular backups are performed, Diwerse cannot guarantee against loss or corruption of data. Users agree to maintain a complete and accurate copy of any content independently of the Diwerse service. Diwerse will provide support for content backup issues but is not liable for content integrity or successful restoration.
Intellectual Property
  • We respect the intellectual property rights of others and respond to claims of copyright or other intellectual property infringement.
  • If you are a copyright owner or authorized representative and believe that content posted on Diwerse infringes upon your rights, you must submit a written notice to our copyright agent via email, including a detailed description of the alleged infringement.
  • Misrepresenting that any content infringes your copyright may result in accountability for damages, including costs and attorney fees.
  • The Diwerse service and its original content, features, and functionality are and will remain the exclusive property of the Company and its licensors.
  • The service is protected by copyright, trademark, and other applicable laws. Unauthorized use of our trademarks and trade dress is prohibited without prior written consent from the Company.
Order Placement and Payment
  • By placing an order through Diwerse, you confirm your legal capacity to enter into binding contracts.
  • To complete an order, you may need to provide information such as your name, email, phone number, credit card details, billing address, and shipping information.
  • Order confirmations, including a detailed summary and estimated delivery times, are sent immediately upon successful order placement.
  • Order confirmations are sent to both the customer and seller's email addresses listed.
  • Customers receive updates on shipping status, tracking details, and any potential delays.
  • You confirm that you have the legal right to use any provided payment method and that the information supplied is accurate and complete.
  • By providing this information, you authorize us to share it with third-party payment processors to facilitate order completion.
  • You are responsible for paying for purchased items unless there's a clear typographical error by the seller. You're solely liable for payment upon commitment to buying an item.
Order Cancellation and Returns
  • We reserve the right to refuse or cancel Your Order at any time for certain reasons including:

    • Errors in the description or prices for Products
    • Errors in Your Order
    • Suspected fraud or unauthorized transactions

Payment Methods
  • We accept payments via Visa, MasterCard, AMEX, Discover, FIMI, EZ Cash and other payment options provided through WebXPay on www.diwerse.com.
  • When you proceed with payment, you will be directed to the respective payment gateway secured with a 128-bit secure socket layer encryption connection of the respective bank.
  • In case of payment failure, please verify your information and ensure sufficient funds are available. Contact your bank's customer center for any safety concerns.
  • If you have any concerns about the safety of online payments, please contact the relevant credit card customer center.
Product Information and Availability

Shipping and Delivery
  • Your items will be delivered through our trusted delivery partner, Koombiyo. We are committed to assisting you throughout this process to ensure a smooth delivery experience. Cash on delivery is available island-wide. We do not currently offer international shipping.

  • Any promotions offered through our service may have their own set of rules separate from our terms of service.
  • If you decide to participate in any promotions, please review the specific rules as well as our Privacy Policy.

Upon termination, your right to use the Service will cease immediately.If you wish to terminate your account, you can simply stop using the Service.

  • These Terms and your use of the Service shall be governed by the laws of Sri Lanka, excluding any conflicts of law rules. Your use of the Application may be subject to other local, state, national, or international laws.
Dispute Resolution

Severability and Waiver
  • Severability:
    • If any provision of these Terms is deemed unenforceable or invalid, it will be modified and interpreted to achieve the intended purpose to the fullest extent permitted by law. The remaining provisions will remain valid and enforceable.
  • Waiver:
    • The failure to exercise a right or enforce an obligation under these Terms will not affect the ability to exercise that right or enforce the obligation in the future. Waiving a breach of these Terms will not constitute a waiver of any subsequent breach.
